Privilege enables a party to withhold certain evidence from other parties and the courts, and can be a valuable tool in litigation, but it is narrowly interpreted. As an HR Indie it important that you understand the disclosure obligation in the event one of your clients receives a tribunal claim, and how privilege impacts your approach and clients.
